Spousal Support/Alimony

“Alimony” or “spousal support,” as it is known in Oregon, can be one of the most complex matters to negotiate or for a court to determine in a divorce.

If you are seeking spousal support, it’s important to know that in Oregon there are three different types of support. Your initial “Petition” or “Response” and the final judgment must specifically state which type of support is being ordered and why.

What Is Considered When Awarding Spousal Support

The factors taken into consideration into an award of spousal support often include the length of the marriage, the income of each party, the health of the parties, the age of the parties, education of the parties, and whether or not either party has been out of the job market for a length of time to be a stay-at-home spouse, and/or a stay-at-home parent.

There Are Three Types Of Spousal Support Available In Oregon

Transitional support is awarded to a spouse who is asking for training and education in order to re-enter the job market and attain some level of economic self-sufficiency.

Compensatory support is offered to the spouse who has sacrificed time and or money to assist the other party in reaching their career goals.

Maintenance support assists the supported spouse in maintaining a standard of living somewhat comparable to the one enjoyed during the marriage. It is most often awarded in situations where there is great disparity between the economic statuses of the parties after the separation.

How Long Will Spousal Support Last?

Support can be ordered for a specific number of years or it can be indefinite depending on the unique circumstances of each case. Important factors to be considered include the number of years married, the health of the parties, the difference in earning abilities and whether or not one or the other has health problems or disabilities.
